1. AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement between you (whether personally or on behalf of an entity) and Michael Roger, Inc., doing business as decomposition.mom ("decomposition.mom," "we," "us," or "our"), governing your access to and use of https://decomposition.mom and any related media, mobile website, or mobile application (collectively, the "Site").

We are registered in New York, United States, with our registered office at PO Box 27176, Brooklyn, NY 11202, United States.

By accessing the Site you confirm that you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE, YOU ARE PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms or documents posted on the Site from time to time are incorporated herein by reference. We may update these Terms at any time by updating the "Last Updated" date above. Your continued use of the Site after any update constitutes acceptance of the revised Terms.

The Site is not designed to comply with industry-specific regulations (HIPAA, FISMA, GLBA, etc.). If your use would be subject to such laws, you may not use the Site.

The Site is intended for users who are at least 18 years old. Persons under 18 are not permitted to register or use the Site.

You may be required to register to access certain parts of the Site. You agree to keep your password confidential and are responsible for all activity under your account. We reserve the right to remove or change usernames we deem inappropriate, obscene, or otherwise objectionable.

We endeavor to display product colors, features, specifications, and details as accurately as possible; however, we do not guarantee accuracy or that your display will reflect actual product attributes. All products are subject to availability, and we reserve the right to discontinue any product at any time. Prices are subject to change.

6. PURCHASES AND PAYMENT

We accept the following payment methods: Visa, Mastercard, American Express, Discover, and PayPal.

You agree to provide current, complete, and accurate purchase and account information and to promptly update it as needed. All payments are in U.S. dollars. Sales tax will be added where required.

You authorize us to charge your chosen payment method for all amounts due. We reserve the right to correct pricing errors even after payment has been requested or received, and to refuse, limit, or cancel any order at our sole discretion.

7. RETURN POLICY

Please review our Return Policy posted on the Site before making any purchases. All orders placed on the Site are deemed offers subject to our acceptance. Accepted orders generally ship within one business day. We will notify you of any shipping delays.

8. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than those for which we make it available. The following activities are expressly prohibited:

- Deleting copyright or proprietary rights notices from any Content;
- Impersonating another user or person;

- Harassing, threatening, or intimidating our employees or agents;
- Attempting to bypass access restrictions on the Site;
- Copying or adapting the Site's source code;
- Using automated systems to access the Site, except standard search engine crawlers;
- Using a buying or purchasing agent to make purchases;
- Collecting usernames or email addresses for unsolicited communications;
- Using the Site to compete with us or for unauthorized revenue-generating purposes;
- Advertising or offering goods and services through the Site; or
- Selling or transferring your user profile.

9. USER GENERATED CONTRIBUTIONS

The Site may provide opportunities to create, submit, post, display, transmit, or distribute content ("Contributions"). Any Contributions you make may be viewable by other users and through third-party websites, and will be treated in accordance with our Privacy Policy.

By making Contributions, you represent and warrant that they:

- Do not infringe any third-party intellectual property, patent, trademark, trade secret, or moral rights;
- Are created by you or you have all necessary licenses and permissions;
- Are not false, inaccurate, or misleading;
- Are not unsolicited advertising, spam, or pyramid schemes;
- Are not obscene, violent, harassing, or otherwise objectionable;
- Do not ridicule, mock, or abuse any person;
- Do not threaten violence against any person or group;
- Do not violate any applicable law or regulation;
- Do not violate any third party's privacy or publicity rights;
- Do not involve child exploitation or otherwise endanger minors; and
- Do not contain offensive content related to race, national origin, gender, sexual orientation, or disability.

Violations may result in termination or suspension of your access to the Site.

10. CONTRIBUTION LICENSE

By submitting Contributions, you grant us a non-exclusive, worldwide, royalty-free license to access, store, process, and use such information and data in accordance with our Privacy Policy and your account settings.

By submitting suggestions, feedback, or other information about the Site ("Submissions"), you agree that we may use and share such Submissions for any lawful purpose without compensation to you. Submissions are non-confidential and become our sole property.

We do not assert ownership over your Contributions. You retain full ownership and all associated intellectual property rights. We are not liable for any statements or representations in your Contributions, and you agree to indemnify us from any claims arising from them.

11. MOBILE APPLICATION LICENSE

Use License

If you access the Site via a mobile application, we grant you a revocable, non-exclusive, non-transferable, limited license to install and use the application on devices you own or control. You may not: (1) decompile or reverse engineer the application; (2) make modifications or derivative works; (3) violate applicable laws; (4) remove proprietary notices; (5) use the application for commercial revenue generation; (6) make it available over a network for simultaneous multi-user access; (7) create competing products; (8) send automated queries or unsolicited email; or (9) use our proprietary information to develop competing applications.

Apple and Android Devices

When accessing via an app from the Apple App Store or Google Play: (1) your license is limited to use on iOS or Android devices per the applicable distributor's terms; (2) we are responsible for maintenance and support, not the App Distributor; (3) warranty claims may be submitted to the App Distributor per their policies; (4) you represent you are not in an embargoed country or on a prohibited persons list; (5) you must comply with applicable third-party terms; and (6) App Distributors are third-party beneficiaries of this license.

12. SUBMISSIONS

Any questions, comments, suggestions, ideas, or feedback you provide to us ("Submissions") are non-confidential and become our sole property. We own exclusive rights, including all intellectual property rights, and may use and disseminate Submissions for any lawful purpose without acknowledgment or compensation. You waive all moral rights to Submissions and warrant you have the right to submit them.

13. SITE MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms; (2) take appropriate legal action against violators, including reporting to law enforcement; (3) restrict access to or disable any Contributions; (4) remove files that are excessive in size or burdensome to our systems; and (5) manage the Site to protect our rights and facilitate proper functioning.

14. PRIVACY POLICY

16. ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING

Data Use for AI Training

To develop, improve, and maintain our products and services, decomposition.mom may use data you provide or generate through your use of the Site — including interactions, submitted content, usage patterns, and feedback — to train, fine-tune, evaluate, and improve artificial intelligence and machine learning models ("AI Systems"). Where practicable, such data will be aggregated, anonymized, or de-identified prior to use.

By using the Site, you grant us a non-exclusive, worldwide, royalty-free license to use your data for these AI training purposes, subject to the terms of our Privacy Policy.

Excluded Data

We will not use the following categories of data for AI training:

- Sensitive personal information (as defined under applicable law);
- Payment card data, financial account information, or security codes;
- Passwords or authentication credentials; or
- Health or medical information.

Opt-Out Right

You may opt out of the use of your data for AI training at any time by contacting us at info@michaelroger.com with the subject line "AI Training Opt-Out." Opting out will not affect your ability to use the Site. We will process your request within 30 days.

Third-Party AI Vendors

We may engage trusted third-party vendors to assist with AI model development. Such vendors are contractually obligated to process data only on our behalf and in accordance with our Privacy Policy and applicable data protection law.

Automated Decision-Making

Where we use AI Systems to make decisions that may significantly affect you, you have the right to request human review of those decisions. To exercise this right, contact us using the details in Section 31.

Jurisdictional Notice

Residents of the European Economic Area and United Kingdom: our legal basis for processing your data for AI training purposes is our legitimate interests in improving our services, subject to your right to object under GDPR Article 21. Residents of California: please see Section 29 for additional rights.

17. DATA RETENTION

We retain personal data only for as long as necessary to fulfill the purposes for which it was collected. Specific retention periods include:

- Account information: retained for the duration of your account plus 3 years after closure.
- Transaction records: retained for 7 years to comply with applicable tax and accounting laws.
- Usage and log data: retained for up to 24 months.
- Marketing data: retained until you opt out or withdraw consent.
- AI training data: retained in identifiable form for up to 24 months, after which it is anonymized or deleted.

When retention periods expire, personal data is securely deleted or anonymized. You may request early deletion of your data — subject to our legal obligations — by contacting us using the details in Section 31.

18. INTERNATIONAL DATA TRANSFERS

The Site is operated in the United States. If you access the Site from outside the United States, your data will be transferred to and processed in the United States, which may have different data protection standards than your country.

19. TERM AND TERMINATION

These Terms remain in effect while you use the Site. WE RESERVE THE RIGHT, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, TO DENY ACCESS TO OR USE OF THE SITE — INCLUDING BLOCKING IP ADDRESSES — FOR ANY REASON, INCLUDING BREACH OF THESE TERMS OR ANY APPLICABLE LAW. WE MAY TERMINATE YOUR ACCOUNT AND DELETE ANY CONTENT OR INFORMATION YOU POSTED AT ANY TIME WITHOUT WARNING.

If your account is terminated or suspended, you may not register a new account under your name, a fake name, or a third party's name. We reserve the right to pursue all available legal remedies.

20. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove Site content at any time without notice. We may also modify or discontinue any part of the Site or its offerings without liability. We cannot guarantee uninterrupted availability and are not liable for any loss or inconvenience caused by downtime.

21. GOVERNING LAW

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods and UCITA are expressly excluded.

22. DISPUTE RESOLUTION

Any legal action shall be commenced in the state or federal courts located in Kings County, New York. Both parties consent to personal jurisdiction and waive any objections to venue in such courts.

No claim arising from use of the Site may be brought more than two (2) years after the cause of action arose.

23. CORRECTIONS

The Site may contain typographical errors, inaccuracies, or omissions relating to products, pricing, availability, or other information. We reserve the right to correct any such errors and update information at any time without prior notice.

WE ARE NOT LIABLE FOR ERRORS, PERSONAL INJURY, UNAUTHORIZED SERVER ACCESS, TRANSMISSION INTERRUPTIONS, BUGS OR VIRUSES, OR ANY LOSS ARISING FROM USE OF CONTENT POSTED ON THE SITE.

25. LIMITATIONS OF LIABILITY

26. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless — including our subsidiaries, affiliates, officers, agents, partners, and employees — from and against any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (1) your use of the Site; (2) your breach of these Terms; (3) breach of your representations and warranties; (4) violation of third-party rights, including intellectual property rights; or (5) any harmful act toward another user of the Site.

27. USER DATA

We maintain certain data you transmit to the Site for operational purposes. Although we perform regular backups, you are solely responsible for your data. We have no liability for any loss or corruption of data, and you waive any related claims against us.

Visiting the Site, sending emails, and completing online forms constitute electronic communications. 30. MISCELLANEOUS

These Terms, together with the Privacy Policy, Cookie Policy, and any other policies posted on the Site, constitute the entire agreement between you and us. Our failure to enforce any provision does not constitute a waiver. If any provision is found unenforceable, the remainder continues in full force. We may assign our rights and obligations at any time. No joint venture, partnership, employment, or agency relationship is created by these Terms.
